2. Purpose

These Terms and Conditions govern access, browsing, and use of the website https://www.martialgi.com, as well as the purchase of products through the online store, or other means of direct contact (namely email, telephone, WhatsApp, or social media).

They apply to all commercial transactions carried out with MartialGi, regardless of the channel used, unless specific clauses are agreed upon in writing.

The use of MartialGi’s sales channels implies full knowledge and acceptance of these Terms and Conditions by the customer.

Only adults legally capable of contracting may make purchases.

3. Intellectual Property

According to the laws and conventions governing intellectual property and/or other similar rights, this website and all elements that compose it, namely trademarks, designs, models, photographs, texts, illustrations, logos, animated or not, sound or not, graphics, are the exclusive property of MartialGi.

Reproduction or use of all or part of these elements is only authorized for exclusive informational purposes, for personal and private use, and all reproductions and any use of copies made for other purposes are expressly prohibited. The entire website, its content, or trademarks may not be used, reproduced, duplicated, copied, sold, resold, made accessible, modified, or exploited in any other way, in whole or in part, for any other purpose.

4. Liability

MartialGi is not responsible for typographical errors, technical lapses, computer viruses and interruptions or failures in payment or transport systems.
The delivery of Products ordered on the website is carried out by third-party companies. MartialGi disclaims all responsibilities in case of delayed delivery of an order, as well as in case of loss of ordered products or service strikes. The client assumes the risks on the delivered products from the moment of shipment.

5. Orders

Placing an order implies acceptance of the prices, descriptions and conditions of the products presented.

To order the products, the customer must add the desired products to the “shopping cart”, fill in the required information, create an account, and finalize the order.

The customer may place an order for the products online and will collect it on his/her preferred shipment address.

Order validation implies full and unrestricted acceptance of these Terms and Conditions.

The customer’s order will only be definitively validated after the customer has selected the delivery and payment methods and completed the purchase.

Before placing the order, the customer must always verify all entered information and then confirm the purchase.

After validating the order, MartialGi will send a confirmation email acknowledging receipt and validation. The data recorded by MartialGi and the proof of payment constitute evidence of the nature, content, and date of the order.

Once the order has been definitively validated, the customer may no longer cancel or modify it, without prejudice to the provisions of Article 8 of these Terms and Conditions. Payment will then be triggered from the moment the order is validated. Depending on the selected option, MartialGi will take all necessay steps to fulfill the customer’s order.

If the product(s) are permanently unavailable, the customer will be informed via email. Subsequently, the order will be reduced or canceled according to the customer’s instructions. Any payment made will be refunded via bank transfer or credited to the customer’s account. If the replacement has a higher value, the customer must bear the additional cost.

All orders must be paid for using the payment methods described at the time of purchase.

MartialGi reserves the right to cancel any order from a customer with whom there has been a prior dispute or for any other legitimate reason, namely, the abnormal nature of the order, indicated by an unusual quantity and/or amount for a final consumer.

6. Payments

The currency used for all Orders is the Euro.

The customer may choose from the following payment methods:

– MB Way;
– Credit Card;
– PayPal;
– Bank Transfer.

The full amount of the order will be debited from the customer’s bank account as of the order date.

If payment authorization is denied by banking entities, MartialGi reserves the right to suspend order processing and any shipment.

7. Deliveries and Deadlines

Orders are shipped after payment confirmation, respecting the deadlines indicated at the time of purchase.

MartialGi is not responsible for delays by carriers or for cases of force majeure (strikes, disasters, etc.).

The risk is transferred to the customer at the time of delivery. Refunds will be processed within 14 days of the customer receiving the goods.

8. Right of Withdrawal

If the product is purchased by a final consumer, they have the right to freely resolve the contract within 14 days from the day they acquire physical possession of the good. The customer must send an email to support@martialgi.com requesting the return of the order. MartialGi will confirm receipt of the email and proceed with the normal return process.

The customer has 14 days to return the order to MartialGi (Via Largo Joaquim Magalhães 22, 4400-187 Vila Nova de Gaia), in its original packaging, with the ordered products properly sealed. Return costs are the responsibility of the customer.

It is important that the customer takes care of the packaging of the returned product(s). Failure to return the order within 14 days from the date the product(s) was received is understood as withdrawal, and consequently, the order is considered final.

Shipping costs are non-refundable. The refund will be made via bank transfer within 14 days from receipt of the returned products.

MartialGi commits to refund the customer the amount of the order corresponding to the returned products, subject to the conditions above.

9. Exceptions to the Right of Withdrawal

Under Article 17 of Decree-Law No. 24/2014, the right of withdrawal does not apply to:

All products sold to consumers benefit from a 3-year conformity guarantee, except in cases of natural wear and tear or misuse.

For professional clients (companies, gyms, instructors), the guarantee is of 6 months, unless otherwise agreed.

The defect must be reported to MartialGi promptly. We reserve the right to inspect the item before any replacement, repair or refund.

11. Data Protection

The processing of personal data is subject to MartialGi’s Privacy Policy, in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679).

The MartialGi website may contain hyperlinks to external websites. MartialGi is not responsible for the content, policies, or practices of these websites.

13. Applicable Law and Jurisdiction

These Terms are governed by Portuguese law.

In case of dispute, and in the absence of an amicable resolution, the Court of the District where MartialGi’s physical mailbox is located shall have jurisdiction, with waiver of any other.

14. Applicable Law – Disputes

These Terms and Conditions and contractual relations between MartialGi and the customer are governed by Portuguese Law.

In case of dispute between MartialGi and the customer, an amicable agreement will be sought between the parties prior to any legal action.

In case of litigation, the consumer client may resort to the alternative consumer dispute resolution entity.

For the appreciation and decision of any dispute arising from the interpretation, discussion, application or breach of the Terms and Conditions and the purchase contract of the products refer to https://martialgi.com/legal/adr/ for the contact of the Consumer Arbitration Tribunal with jurisdiction for alternative resolution of consumer disputes (ADR).

Every purchase by a customer implies on their part the explicit and irrevocable waiver of any legal action of any nature that is not under the exclusive jurisdiction of Portuguese law.
